Status: Entered into force on 16 January 2023. Member States are required to transpose it into national law by 17 October 2024.

Full name: Directive (EU) 2022/2557 of the European Parliament and of the Council of 14 December 2022 on the resilience of critical entities and repealing Council Directive 2008/114/EC.

Objective and key elements:

  • Objective: Enhance the resilience of critical entities providing essential services across the EU to ensure the continuity of vital societal functions and economic activities.
  • Key elements include:
    • Scope: Applies to critical entities in sectors such as energy, transport, banking, financial market infrastructure, health, drinking water, waste water, digital infrastructure, public administration, space, and food production, processing, and distribution.
    • Risk assessments: Member States must conduct regular risk assessments to identify critical entities and evaluate risks that could disrupt the provision of essential services.
    • Resilience measures: Critical entities are required to implement appropriate and proportionate measures to ensure their resilience against various risks, including natural disasters, terrorism, insider threats, and public health emergencies.
    • Incident notification: Critical entities must notify competent authorities of incidents that significantly disrupt or have the potential to significantly disrupt the provision of essential service.
    • Support and oversight: Member States are to provide support to critical entities, including guidance and training, and establish competent authorities to oversee the implementation of the Directive.

Relevant to: Operators and providers in sectors deemed critical, including energy, transport, banking, health, drinking water, waste water, digital infrastructure, public administration, space, and food production and distribution.

Swedish implementation: Sweden has not yet transposed the directive into local law (delay). Please see this link to get to the Swedish final report regarding the implementation of the CER-directive (published on 18 September 2024).
