New EUIPO study on how GenAI is challenging copyright law

A new EUIPO-commissioned study examines how Generative AI is reshaping the copyright landscape, raising new challenges around how to protect intellectual property while supporting continued innovation.

The report highlights the growing importance of licensing high-quality content for AI training and establishing clear mechanisms for rights reservation. While no universal solution currently exists, two main approaches are emerging:

Input phase: Rightsholders may opt out of AI training under the ‘text and data mining’ exception.
Output phase: Transparency tools can help identify AI-generated content.
